TERMS OF SERVICE & USER AGREEMENT
PLEASE READ THESE TERMS CAREFULLY BEFORE USING FAMILY CASE COMPASS
By creating an account and using Family Case Compass (the "Service"), you agree to be bound by these Terms of Service and User Agreement ("Agreement"). If you do not agree to these terms, do not use the Service.
This Service is provided by Pash Company ("Company," "we," "us," or "our").
1. SERVICE DESCRIPTION AND LIMITATIONS
Family Case Compass is an AI-powered legal analysis tool that analyzes family law documents, identifies arguments, applies relevant legal standards, and generates sample court orders.
CRITICAL LIMITATIONS YOU MUST UNDERSTAND:
a) NOT LEGAL ADVICE: Family Case Compass does NOT provide legal advice. The Service provides information and analysis tools only. You should not rely on any output from the Service as legal advice or as a substitute for consultation with a licensed attorney.
b) NO GUARANTEE OF RESULTS: Using Family Case Compass does not guarantee any particular outcome in your legal matter. Court decisions depend on many factors including judicial discretion, evidence presentation, witness credibility, and circumstances not reflected in written documents.
c) NOT A REPLACEMENT FOR LEGAL JUDGMENT: The Service is designed to assist with legal analysis, not replace sound legal judgment. All outputs should be reviewed and evaluated by you or your legal counsel before being relied upon.
d) AI LIMITATIONS: The Service uses artificial intelligence which, while sophisticated, may:
- Make errors in analysis or application of law
- Miss important nuances in your case
- Apply outdated or incorrect legal standards
- Generate outputs that require verification
- Produce results that vary based on how information is presented
e) BETA/EVOLVING TECHNOLOGY: The Service is continuously being improved. Early users should expect the system to evolve and improve over time.
2. STRONGLY RECOMMENDED: SEEK LEGAL COUNSEL
Pash Company and Family Case Compass STRONGLY ENCOURAGE all users to:
a) Consult with a licensed attorney in your jurisdiction about your legal matter;
b) Have any analysis or output from the Service reviewed by qualified legal counsel before relying on it;
c) Understand your legal rights and obligations through consultation with a lawyer;
d) Recognize that self-representation, even with technological assistance, carries significant risks.
Family law matters involving custody, support, and property division have serious, long-lasting consequences for you and your family. Professional legal guidance is invaluable and often essential to protecting your rights and achieving the best possible outcome.
3. NO ATTORNEY-CLIENT RELATIONSHIP
Use of Family Case Compass does not create an attorney-client relationship between you and Pash Company, Family Case Compass, or any individual associated with either entity. We are not a law firm and do not provide legal representation.
4. ACCURACY AND RELIABILITY
While we strive to provide accurate analysis:
a) We make NO WARRANTY regarding the accuracy, completeness, or reliability of any analysis, information, or output provided by the Service;
b) Legal standards, statutes, and case law change frequently. We cannot guarantee that our system reflects the most current law in your jurisdiction;
c) You are solely responsible for verifying any information or analysis before acting on it;
d) We are not liable for any errors, omissions, or inaccuracies in the Service's output.
5. USER RESPONSIBILITIES
By using the Service, you represent and warrant that:
a) You are at least 18 years old and have the legal capacity to enter into this Agreement;
b) You will use the Service in compliance with all applicable laws and regulations;
c) If you are a legal professional, you will comply with all professional responsibility rules and ethical obligations;
d) You understand the limitations described in this Agreement;
e) You will not rely solely on the Service's output for legal decision-making;
f) You are responsible for obtaining any necessary consents before uploading information about third parties;
g) You will verify all information and analysis provided by the Service.
6. CONFIDENTIALITY AND DATA SECURITY
a) We implement reasonable security measures to protect your information;
b) However, no system is completely secure. You acknowledge the inherent risks of transmitting information over the internet;
c) You are responsible for maintaining the confidentiality of your account credentials;
d) If you are a legal professional, you are responsible for ensuring that your use of the Service complies with your professional obligations regarding client confidentiality.
7. PROHIBITED USES
You may not use the Service to:
a) Engage in any unlawful activity;
b) Harass, threaten, or harm others;
c) Upload false, misleading, or fraudulent information;
d) Attempt to circumvent any security features;
e) Use the Service in any manner that could damage, disable, or impair the Service;
f) Use the Service to develop competing products or services.
8. INTELLECTUAL PROPERTY
a) All content, features, and functionality of the Service are owned by Pash Company and are protected by copyright, trademark, and other intellectual property laws;
b) Any feedback or suggestions you provide about the Service become the property of Pash Company;
c) You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
9. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
a) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT;
b) WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
c) WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION, ANALYSIS, OR OUTPUT;
d) WARRANTIES THAT THE SERVICE WILL MEET YOUR NEEDS OR EXPECTATIONS.
YOU USE THE SERVICE AT YOUR OWN RISK.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
a) PASH COMPANY AND FAMILY CASE COMPASS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits or revenue
- Loss of data
- Cost of substitute services
- Adverse legal outcomes
- Damages arising from reliance on the Service
b) OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.
c) SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Pash Company, Family Case Compass, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
a) Your use or misuse of the Service;
b) Your violation of these Terms;
c) Your violation of any law or regulation;
d) Any information or content you submit to the Service;
e) Any action you take based on information or analysis provided by the Service.
12. MODIFICATIONS TO SERVICE AND TERMS
a) We reserve the right to modify, suspend, or discontinue the Service at any time without notice;
b) We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the modified Terms;
c) We will notify you of material changes by posting a notice on our website or by email.
13. TERMINATION
a) You may terminate your account at any time;
b) We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice;
c) Upon termination, your right to use the Service immediately ceases;
d) Sections relating to intellectual property, disclaimers, limitations of liability, and indemnification survive termination.
14. GOVERNING LAW AND DISPUTE RESOLUTION
a) This Agreement shall be governed by the laws of the State of Minnesota, without regard to conflict of law principles;
b) Any disputes arising from or relating to this Agreement or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association;
c) You waive any right to participate in a class action lawsuit or class-wide arbitration;
d) Notwithstanding the foregoing, either party may seek injunctive relief in court to prevent irreparable harm.
15. SEVERABILITY
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and Pash Company regarding the Service and supersedes all prior agreements and understandings.

ACKNOWLEDGMENT
BY CREATING AN ACCOUNT OR USING THE SERVICE, YOU ACKNOWLEDGE THAT:
1. You have read and understood these Terms of Service;
2. You understand that Family Case Compass is NOT a substitute for legal advice from a licensed attorney;
3. You understand that using the Service does NOT guarantee any particular outcome in your legal matter;
4. You understand that all output from the Service should be verified and reviewed before being relied upon;
5. You are strongly encouraged to seek consultation with a qualified attorney regarding your legal matter;
6. You accept all risks associated with using the Service;
7. You agree to be bound by all terms and conditions set forth in this Agreement.
